Pupil Protection Laws

Who?   All school employees
What?   Requires all school employees to be fingerprinted and have a background check (Federal and state). The background check will show any felony on your record and some misdemeanors. The law requires the discharge of any employee who has been convicted of a crime covered by the Sexual Offenders Registration Act. Any other conviction of a felony will require the permission of the school board and the superintendent to continue working in the district. After January 1, 2006, if an employee does not report a listed charge or conviction within three (3) days of the event, he/she is guilty of an additional crime. Anyone charged with a crime after January 1, 2006 should contact Local 1 to discuss the impact, if any, on your certification and employment.
Where?   In Michigan there are reported to be about 400 administrators and 1500 other school employees with felonies on their records. This is public information and will be available in January 2006.
When?   Beginning January 2006. The law takes effect then and the media may publish the lists. Criminal records are a matter of public record.
Why?   To comply with the School Safety Legislation. If you have any concerns regarding this law and how it could affect you, please contact Local 1 (586-228-0100) and ask for Dan Hoekenga.
