Sick Bank Committee Administrative Procedures

Purpose:

The contract provides a process whereby teachers who exhaust their own personal sick leave days due to illness or injury may make reasonable withdrawals from a common bank.

I. Committee Powers:

A. The Novi EA Sick Bank Committee shall be composed of at least three (3)
members appointed by the Association president and approved by the
Novi EA Board of Directors. A quorum shall be a simple majority.

B. The Novi EA Sick Bank Committee shall be empowered to approve or deny
all applications for withdrawals from the Sick Bank.

C. The Committee shall meet as often as necessary to review and act upon
applications for withdrawals from the Sick Bank.

II. Criteria for Withdrawals:

A. Applicants requesting withdrawals from the Sick Bank must have
exhausted their own personal sick leave accumulation.

B. No withdrawals from the Sick Bank may be made after the personal sick
leave has been exhausted until the applicant has had five (5) consecutive work days without compensation. After the applicant has been absent ten (10) consecutive work days due to the same or directly related disability, the five (5) days without compensation will be reimbursed.

C. In the event of "non-consecutive" illness/treatment (such as recurrence of illness or chemotherapy) the initial five (5) days without compensation shall
apply.

D. Applicants requesting withdrawals from the Sick Bank must submit
verification from the District's Payroll Office that their personal sick leave
accumulation has been exhausted.

E. Applications for the use of Sick Bank days should be submitted to the
Novi EA Sick Bank Committee on forms available from the Sick Bank
Chairperson. The Chairperson is Scott Hill, Parkview Elementary.

F. Applicants shall submit to the Committee verification of their illness or disability from their attending physician. The Committee reserves the right to request that the applicant provide a second physician's opinion.

G. Applicants will not be awarded more than thirty (30) work days per school
year.

H. "Shared time" applicants will not be awarded days which exceed the percentage he/she is employed. (eg. .5 employee shall not be awarded more than fifteen (15) work days per school year.)

I. Applicants must sign and return to Sick Bank Committee Chairperson the
Sick Bank Application/Reimbursement Obligation form before the days will be authorized.

J. The Committee shall indicate the disposition of all requests in writing to
the applicant. The applicant may then appeal this decision utilizing
Section V.


III. Exclusions:

Applicants will be excluded from making withdrawals from the Sick Bank if:

A. Their personal leave days have not been exhausted; or

B. They are receiving Worker's Compensation Benefits; or

C. They are receiving long-term disability (LTD) benefits.

IV. Reimbursement Obligations:

A. Persons withdrawing sick leave days from the Sick Bank shall reimburse
the days in subsequent employment years, at a rate of five (5) days per
school year.

B. "Shared time" employees withdrawing sick leave days from the Sick Bank shall reimburse the days in subsequent employment years, at a rate which is equal in percentage to that which he/she is employed. (eg. .5 employee shall reimburse 2.5 days per year.)

C. A person (estate) who does not return to work because of health reasons
or death will not be responsible for reimbursing days that were granted
by the Sick Bank Committee. A person who terminates employment shall
be required to pay monetary compensation equal to the days granted,
paid to the Association Scholarship Fund.

V. Appeals:

Any applicant whose request for withdrawal from the Sick Bank is denied may appear in person before the Sick Bank Committee to appeal his/her case.

An applicant wishing to appeal a denial should make a written request to appear
before the Sick Bank Committee. The written request should be sent to the Sick
Bank Committee Chairperson.

If the applicant is not satisfied with the disposition of the Sick Bank Committee
pursuant to the appeal, that decision may be appealed to the Novi EA Board of
Directors by submitting a written request to the Novi EA President. This request will ask the Novi EA Board of Directors to review the Sick Bank Committee's decision.

The final decision of the Novi EA Board of Directors is not grievable under the provisions of the Master Agreement.
